Welcome to Trademark.io (the “Platform”), which is operated by Squadhelp LLC, with platform and technical infrastructure provided by Atom.com. These Terms of Service (“Agreement”) govern your access to and use of all services available at Trademark.io, including but not limited to our free trademark search, premium trademark reports, trademark filing, and brand monitoring (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by this Agreement. If you do not agree, do not use the Platform.

1. Eligibility and Registration

You must be at least 18 years old and legally capable of entering into contracts. To access certain features, you may be required to create an account. You agree to provide accurate and complete information and to maintain the security of your login credentials.

2. Description of Services

2.1 Free Trademark Search

Our search tool checks U.S. and/or international trademark databases for identical or closely matching marks. This is an informational tool only and does not constitute legal advice or a guarantee of trademark availability or registrability.

2.2 Premium Trademark Reports

These reports analyze potential risks, identify conflicting marks, and help evaluate registration success. Reports may be prepared by trademark professionals and/or automated systems.

2.3 Trademark Filing

Trademark.io facilitates trademark filings through licensed attorneys. By purchasing this service, you agree that we may share your information with attorneys or third-party providers in order to fulfill your request.

2.4 Brand Monitoring

We provide ongoing monitoring of trademarks and domains to help identify potential infringements. Monitoring is based on public data and proprietary systems and is informational in nature.

3. No Legal Advice

Trademark.io is not a law firm. No attorney-client relationship is created unless you separately engage with a licensed trademark attorney. Use of our Services does not constitute legal advice.

4. Intellectual Property

All materials on the Platform—including text, design, and software—are owned by Squadhelp LLC or its licensors. You may not reproduce or distribute any content without express written permission, except for your own personal use.

5. User Responsibilities

You agree not to:

• Use the Services for any unlawful purpose
• Misrepresent your identity or intent
• Share or resell data obtained through the Platform
• Attempt to interfere with or reverse-engineer our systems

You are solely responsible for ensuring your use of the Services complies with all applicable laws, including those related to intellectual property and trademark rights.

6. Payments and Refunds

Certain Services require payment. Prices are listed in USD.

Refunds are available under the following conditions:

• Premium report refunds may be requested within 7 days, if the report has not been delivered or contains material errors
• Filing services are non-refundable once processing has begun
• No refunds are offered on free tools or completed brand monitoring cycles

7. Legal Services and Bundled Payments

Certain Services offered through the Platform may involve legal services provided by independent licensed attorneys (“Attorneys”). In most cases, Attorneys will collect their legal fees directly from the Customer pursuant to a separate engagement.

• 1. Collection of Payment

  Atom LLC (“Atom”) may collect the total payment from the Customer as a convenience.

• 2. Attorney Fees Remitted in Full

  The portion of the payment attributable to Attorney fees will be remitted directly to the Attorney in full, without any commission or percentage retained by Atom.

• 3. Platform Service Fee

  The portion of the payment attributable to the Trademark.io platform and administrative services is retained by Atom as its service fee.

• 4. Separate Legal Relationship

  Legal services are provided solely by the Attorney. Atom is not a law firm, does not provide legal advice, and does not supervise or control the Attorney’s legal work. The attorney‑client relationship exists only between the Customer and the Attorney.

Limitation of Liability

Services are provided “as is” without warranties of any kind. To the fullest extent allowed by law, Squadhelp LLC, Atom.com, and their affiliates shall not be liable for any indirect or consequential damages. Total liability under this Agreement shall not exceed the total fees paid by you for the Services in question.

8. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

9. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Illinois. Any dispute shall be resolved by binding arbitration in Cook County, Illinois, in accordance with the rules of the American Arbitration Association. Class actions and jury trials are expressly waived.

10. Changes to Terms

We may revise these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
